These Terms & Conditions (“Terms”) are a binding agreement between you and Workkk (“Workkk”, “we”) governing your access to and use of the Workkk website at workkk.tech, the web workspace, and the desktop agent (together, the “Service”). By creating a workspace or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Workkk provides a living digital office: real-time presence, work timers and attendance, consent-first screenshots, activity signals, requests and approvals, and a desktop agent. Features vary by plan (Starter, Team, Business, Enterprise). We may add, change or remove features to improve the Service. Some capabilities are described as “coming soon” and are not guaranteed.

When you create an office you get a tenant workspace at yourslug.workkk.tech. You are responsible for the accuracy of your details, for all activity under your workspace, and for keeping credentials secure. The person who creates a workspace is its administrator and warrants they are authorised to bind their organisation.

This is important. When you monitor your team using Workkk, you are the data controller. You are solely responsible for:

• Having a valid legal basis to monitor your employees where you operate.
• Informing employees clearly about what is monitored, and obtaining any required consent.
• Using monitoring proportionately, for legitimate work purposes only.
• Complying with employment, privacy and surveillance laws that apply to you.

You must not use the Service to break the law, to harass or surveil people unlawfully, to monitor outside a lawful employment context, or to circumvent the consent and transparency features built into the product. We may suspend workspaces that we reasonably believe violate these Terms.

• Paid plans are billed per seat, monthly or annually, in advance.
• Free trials, where offered, require no card and convert only if you choose to continue.
• Test-mode payment. Checkout is currently a simulated stub — no real card is charged or stored. When real billing launches, these Terms will be updated and you’ll be notified before any charge.
• Except where required by law, fees are non-refundable; you can cancel to stop future charges.

The Service, including its software, design and brand, is owned by Workkk and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Your data remains yours; you grant us the rights needed to operate the Service for you.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, Workkk will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

You may stop using the Service and close your workspace at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends; we will handle your data as described in the Privacy Policy.

These Terms are governed by the laws of Gujarat, India, without regard to conflict-of-laws rules, and the courts of Gujarat, India have exclusive jurisdiction, unless mandatory local law provides otherwise.

We may update these Terms as the Service evolves. We’ll revise the “last updated” date and, for material changes, give reasonable notice. Continued use after changes take effect means you accept the updated Terms.
